Attorneys in Thelen’s Asia Pacific practice group have extensive experience doing business in South Asia. We have been involved in numerous significant transactions in India and South Asia over the years. Indeed, our firm played a key role in connection with the largest single foreign investment ever made in India. We represented Bechtel and General Electric in the successful restructuring of the $3 billion Dabhol Energy Project. The project consisted of three power plants and an associated LNG facility located in the State of Maharashtra. The restructuring involved extensive negotiations with offshore and Indian lenders, as well as with the state and union governments. Other responsibilities included overseeing numerous arbitrations and litigations involving bilateral investment treaties, political risk insurance, and project agreements. Our efforts led not only to a successful resolution regarding our clients’ investments, but to the eventual participation of our clients’ contractor entities in the restart and contemplated completion of the project. It is a hallmark of how we, as a firm, approach matters on behalf of our clients. We not only helped our clients to achieve a successful outcome in the matter, but we did so in a manner that led to the creation of strong, positive working relationships with the leading Indian governmental and banking figures who were involved.
Another example of the depth and extent of our involvement in the internationalization of the Indian and other South Asian economies is provided by the cutting edge role that we have played in outsourcing and intellectual property matters. Our firm has played a leading role in the development of the outsourcing industry. We represent not only U.S. and other international companies outsourcing critical functions to Indian services providers, but also Indian service providers doing business with U.S. and other international companies.
